The promoters of
\nthe company is require to decide the propose name of the company. The propose
\nname should not be identical or similar name of the any existing company in
\nIndia. The promoter should check the name availability on MCA Website<\/a>. <\/p>\n

After the
\nverification of availability of name, promoters need to finalized the at least
\nsix unique names. Then prompters are required to upload Form 1A with
\ndigital signature and pay the fees. <\/p>\n

While deciding
\nthe proposed name promoter should take into account the departmental guidelines<\/a>
\nissued by MCA.  <\/p>\n

Some important points of
\nname guidelines are as below:- (These are the old guidelines under Company Act 1956. For Name guidelines under Company Act 2013 Kindly refer <\/strong>https:\/\/taxclick.org\/type\/company-law\/name-guidelines-for-reservation-of-name-of-the-company-under-company-act-2013<\/strong><\/a> )   <\/p>\n

1)     
\nThe name of the company should be in according
\nwith the principal object of the company. However it is not necessary that
\nevery name should indicate its object. But when there is some indication of
\nbusiness in the name then it should be in conformity with its object.  For example if propose name is \u201cXYZ SOFTWARE
\nPVT LTD\u201d then object of the company should be relating to software (it may developing,
\ntrading or dealing in software).<\/p>\n

2)     
\nThe name like Chit Fund, Investment, Loan, etc
\nis allowed only for such company whose main business is finance.<\/p>\n

3)     
\nThe propose name should not be close phonetic
\nresemblance to the name of company in existence for example, J. K. Industries
\nlimited is the existence company propose name should not be Jay Kay Industries
\nLimited.<\/p>\n

4)     
\nName should not be contain popular abbreviation
\nof well known companies like TISCO (Tata Iron and steel company) etc.<\/p>\n

5)     
\nThe name should not be general name, like
\n\u201cSoftware Development Limited\u201d it should be specific name, like \u201cXYZ Software Development
\nLimited\u201d.<\/p>\n

6)     
\n  The
\nwords like \u201cCo-Operative\u201d, Sahakari\u201d or equivalent to the word \u201cCo-Operative\u201d
\nin regional language is not allowed.<\/p>\n

7)     
\nImproper name which attracts provisions of the
\nEmblems and Names (Prevention of improper use) Act, 1950 is not allowed.<\/p>\n

8)     
\nName should not indicate the Government\u2019s
\nparticipation unless there are such circumstances.   Examples names like, National, Union,
\nCentral, Federal, Republic, President, etc.<\/p>\n

9)     
\nThe name \u201cBritish India\u201d is not allowed.<\/p>\n

10)  
\nThe names showing the connection with local
\nauthority or union or state government is also not allowed. Example name like,
\nMunicipal, Panchayat, etc <\/p>\n

11)  
\nIf proposed name includes the name of the
\nregister trade mark, then no objection certificate from the registered owner of
\nthe trade mark is required. <\/p>\n

12)  
\nName should not be identical with or too nearly
\nresembles with previously registered company. For example existence company
\nname is \u201cHindustan motor and general finance company\u201d the propose name
\n\u201cHindustan Motor Limited\u201d.<\/p>\n

13)  
\nOnly adding the name like New, Modern, etc.
\nbefore the name of existing company is not allowed. Example name like \u201cNew Reliance
\nIndustries Limited\u201d.   <\/p>\n

14)  
\nIf proposed name includes the name like French,
\nBritish, German is allowed only when there is some collaboration or connection
\nwith foreigners of that particular company or place. <\/p>\n
